Exclusive distribution

1. Brokerage order

The brokerage order is already made by the fact that the client takes advantage of our activity. The brokerage order therefore does not require any form. By placing an order, the client agrees to these general terms and conditions.


2. Brokerage Commission

Upon conclusion of a purchase or other contract established by us or by our mediation, the fee is earned, due and payable on the day of the conclusion of the contract. Unless otherwise agreed in writing, the following fee rates apply: For purchase contracts, 3.57% of the respective purchase price, including the applicable legal value added tax; the fee entitlement also arises when the acquisition of the proven property takes place in the foreclosure auction.


3. Prior knowledge

If the client is already aware of a property proven or brokered by Immobilienwelt Rehage & Partner GmbH, s/he is obliged to notify us in writing within three working days, disclosing the source of information. Otherwise, the client cannot rely on such knowledge.




4. Prohibition against disclosure

All information, including the proof of property by us, are exclusively intended for the respective client. The client undertakes to treat all communications and documents confidentially. The client is not permitted to pass on the property's credentials and information to third parties without the express consent of the broker, which must be obtained in writing. If the client violates this and the third party thereby arrives at a transaction or other economic advantage, the client must pay us the agreed commission plus value added tax without us needing proof of damage.


5. Disclaimer of liability

Claims for damages against us are excluded with the exception of grossly negligent or intentional actions. The information provided by Immobilienwelt Rehage & Partner GmbH regarding the property is based exclusively on the information given to it by third parties, in particular by the seller or by a third party commissioned by the latter. It is expressly pointed out that we have not checked these third party details for their correctness. A liability for the correctness and completeness of the information, which is only passed on by us, can therefore not be assumed.


6. Dual Action

The Immobilienwelt Rehage & Partner GmbH is entitled to act for the respective contracting party against payment or free of charge.


7. Jurisdiction

If brokers and contractors are registered traders within the meaning of the German Commercial Code, then both the place of fulfillment and the place of jurisdiction are the registered office of the company Immobilienwelt Rehage & Partner GmbH.


8. Miscellaneous

The property is sold / leased by Immobilienwelt Rehage & Partner GmbH as a broker. The client must inform us of unsolicited direct negotiations and their contents. The company Immobilienwelt Rehage & Partner GmbH  has the right to be present at the time of conclusion of the contract as well as a copy of the contract to be issued immediately and any ancillary agreements pertaining thereto, insofar as these are of importance for the calculation and due date of the brokerage fee.
